The people living with HIV (PLHIV) Stigma Index study in Tamil Nadu is the first of its kind to quantify the stigma and discrimination experienced by people living with HIV in the state. The study was conducted between December 2010 to September 2011.and used a cross sectional design to survey a sample of 1594 people living with HIV.

This Policy Brief is adapted from the UNDP and APCOM report, titled ‘Legal environments, human rights and HIV responses among men who have sex with men and transgender people in Asia and the Pacific: An agenda for action’, covering 48 countries and territories of the Asia and Pacific region.
The study considered legislation, cases, published research, policy reports and press reports, and drew from consultations with community representatives, legal experts and UN agencies. The following summarizes findings and recommendations relating to South Asia with inputs from two of APCOM coalition members: INFOSEM (India Network for Sexual Minorities) and SAMAN (South Asia MSM and AIDS Network).

Empower is a Thai sex worker organization started by Ms. Chantawipa Apisuk, a group of sex workers and activists in Patpong, Bangkok’s in 1984. In 2010 Empower decided to undertake a nation-wide community research project to identify and document the impact of the current Thai anti-trafficking law, policy and practice, on sex workers in Thailand, and to develop relevant and achievable solutions. There were 206 Thai and migrant sex workers had become part of the RATS-W project; leading the research consultations, interviewing, giving expert testimony, investigating and undertaking the analysis and preliminary documentation. The 206 sex workers who worked on the project can be divided into 170 research partners; 36 research leaders coordinated by a research working team of four. They are all referred to herein as research leaders, research partners or sex workers interchangeably.

This manual is intended to be used primarily to train about the rights of people living with HIV (PLHIV), people affected by HIV and key affected populations as well as about the remedies available to protect those rights in Viet Nam.
The purpose of the training manual on HIV and the Law is to provide guidance on how to raise awareness of the rights of PLHIV, people affected by HIV and key affected populations, and how to share information with the legal and PLHIV communities about how to seek justice when those rights are violated.

The report is intended to provide an evidence-base for: policy makers working in government, regional and multilateral organizations; parliamentarians; members of the judiciary; civil society organizations; donor agencies; and sex workers and their organizations engaged in advocacy to improve the legal and policy enabling environment for HIV responses. The study focuses on 48 countries of the Asia Pacific region, with an emphasis on low and middle-income countries.

Tackling stigma and discrimination for improved HIV prevention and treatment is particularly critical in Greater Mekong Region (GMR) countries of the Lao People’s Democratic Republic (Lao PDR), Myanmar, and Thailand, given that the epidemic is concentrated and growing amongst groups who face not only HIV-related stigma and discrimination, but also the underlying and HIV-associated stigmas of sex work, drug use, gender identity, and same-sex relationships.

The Global Commission on HIV and the Law is an independent body, established at the request of the Programme Coordinating Board of the Joint United Nations Programme on HIV/AIDS (UNAIDS) and supported by a Secretariat based at the United Nations Development Programme (UNDP). The worldwide use of our data for entry and residence regulations makes it vital for us to update this overview regularly, in order to be able to provide PLHIV with access to the most current information at all times. This new issue is based on the results of a new worldwide survey of the foreign representatives of 200 countries, made between November 2007 and June 2008 with the support of the German foreign ministry. All changes that have occurred since then are integrated in this update. This new edition of the Quick Reference guide contains all the changes we have become aware of up to the beginning of 2012.
